Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the Capsule Memories service available at capsulememories.com (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the “Last Updated” date above. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Capsule Memories is a digital memory preservation platform that allows users to:

• Upload and store photos, videos, voice memos, documents, and journal entries (“Memories”)
• Organize Memories into named collections called “Capsules”
• Order custom-printed hardcover books based on a Capsule’s contents

The Service is intended for personal, non-commercial use. We are a U.S.-based company and the Service is operated from the United States.

3. Accounts and Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@capsulememories.com if you suspect unauthorized access to your account.

You may not create more than one account per person or transfer your account to another individual without our prior written consent.

4. Subscriptions and Billing

Free Trial

New accounts include a 30-day free trial. A valid payment card is required to begin your trial. Your card will not be charged during the 30-day trial period, and we will notify you by email before the trial ends. Unless you cancel before the trial period ends, your subscription will begin and your card will be charged.

Paid Plans

Capsule Memories offers monthly and annual subscription plans. Subscription fees are charged in advance and are non-refundable for the current billing period, as described in our Refund Policy. You may cancel at any time; cancellation takes effect at the end of your current paid period.

Automatic Renewal

Subscriptions renew automatically unless cancelled before the renewal date. By providing a payment method, you authorize us to charge that method on a recurring basis for your selected plan.

Price Changes

We may change subscription pricing with at least 30 days’ advance notice. If you do not cancel before a price change takes effect, your continued use of the Service constitutes acceptance of the new price.

Payment Processing

All payments are processed by Stripe. By making a payment you also agree to Stripe’s terms of service. We do not store your full payment card details on our servers.

5. Physical Printed Books

You may order a custom-printed hardcover book based on the content in a Capsule. Physical book orders are one-time purchases processed through Stripe. Books are custom-manufactured products; please review our Refund Policy for the applicable return and replacement terms.

By placing a book order you represent that you own or have the right to use all content included in that Capsule, and that the content does not violate any applicable laws or third-party rights.

6. User Content

Your Content, Your Responsibility

You retain ownership of all photos, videos, audio recordings, documents, and text you upload to the Service (“User Content”). By uploading User Content, you grant Capsule Memories a limited, non-exclusive, royalty-free license to store, display, and process your content solely as necessary to provide the Service to you (including generating printed books you order).

You are solely responsible for ensuring you have the right to upload any content you submit. You must not upload content that:

• Infringes any copyright, trademark, or other intellectual property right
• Contains nudity, sexually explicit material, or graphic violence
• Depicts or promotes illegal activity
• Harasses, defames, or threatens any person
• Contains malware, viruses, or other harmful code
• Violates any applicable law or regulation

Content Removal

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful or objectionable, without prior notice.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Scrape, crawl, or systematically download content from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service to send spam or unsolicited communications
• Reverse engineer, decompile, or attempt to extract the source code of the Service

8. Third-Party Services

The Service relies on the following third-party providers to operate. Your use of the Service is also subject to their respective terms and privacy policies:

• Stripe — payment processing (stripe.com/legal)
• Supabase — database and file storage (supabase.com/terms)
• Cloudflare — video hosting and delivery (cloudflare.com/terms)
• Resend — transactional email delivery (resend.com/legal)

We are not responsible for the practices, availability, or content of any third-party service.

9. Intellectual Property

All software, design, trademarks, logos, and other materials comprising the Service (excluding User Content) are owned by or licensed to Capsule Memories and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

10. Privacy

Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Service you acknowledge that you have read and understood our Privacy Policy.

11. Data Retention and Account Deletion

You may delete your account at any time by contacting us at support@capsulememories.com. Upon deletion, your User Content and personal data will be removed from our active systems within a reasonable time, subject to any legal retention obligations and the terms of our third-party providers. We are not responsible for any loss of content following account deletion.

We may suspend or terminate accounts that have been inactive for an extended period. We will attempt to provide advance notice before doing so.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We strongly recommend that you maintain independent backups of any content you upload. While we take reasonable measures to protect your data, we cannot guarantee against data loss.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Capsule Memories and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to us in the 12 months preceding the claim, or (b) $50 USD.

14. Indemnification

You agree to indemnify, defend, and hold harmless Capsule Memories and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your User Content, your use of the Service, or your violation of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

16. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Capsule Memories with respect to the Service and supersede all prior agreements and understandings.
